Probate

Probate is the term that is used to describe the process of applying for the right to deal with a person’s affairs after they have died (called 'administering the estate').

When a person dies someone has to deal with their Estate (money property and possessions) by collecting in their money, paying their debts and distributing what is left to those people who are entitled to it under the Will, or if there is no Will, in accordance with the intestacy rules.

Dealing with the estate of someone who has died is a complicated business. First and foremost there is the emotional stress and grief suffered by the suffered by the bereaved family. Often the deceased’s property and possessions have to be sold so that the proceeds can be divided between the beneficiaries. There is usually tax implications to consider; whether it be income tax, capital gains tax and inheritance tax.

Coping with these matters at a time issues practical and the emotional consequences of a death can be very difficult. We can lift some of the burden by administering an estate efficiently and sensitively, and removing the responsibility and pressure outside the family.
